Planning Appeal Granted Against North Yorkshire Council

Extension in Green Belt

North Yorkshire Council refused planning permission for an extension to a dwelling in the Green Belt, based on the definition of 'original dwellinghouse', alongside 'impact' on the Green Belt and Conservation Area. The loss of grassland to facilitate the requirement for car parking was also a material consideration, alongside the impact on the Conservation Area, as a consequence.


Working in collaboration with Townscape Architects - Astrum Planning successfully argued to the Inspector that the proposed extension would not have a material impact on the Green Belt, and was proportionate to the character of the building (which historically comprised five former cottages) and wider area. This was achieved by providing detail calculations and an assessment of the character of the area, including views in and out of the Site.


Astrum Planning also argued that the requirement for 3 car parking spaces (in accordance with Highways) at the frontage of the Site would not be out of character with the conservation area, and would be mitigated by the presence of hedging and grassland.


The appeal was allowed, and will enable the building to function as a family dwelling. The client was delighted.
